Overview

These Terms and Conditions (“Terms”) apply to the Make Believe Ideas website, online store and related services (together, the “Services”). The terms “Make Believe Ideas”, “we”, “us” and “our” refer to Make Believe Ideas Ltd, a company registered in England and Wales under company number 05140300. Our registered office is The Wilderness, Berkhamsted, Hertfordshire, HP4 2AZ, United Kingdom.

Our online store is hosted by Shopify. These Terms, together with the policies and information referred to in them, explain the respective rights and responsibilities that apply when you access the Services or place an order. Please read them before using the Services. Nothing in these Terms limits any mandatory right that applies to you as a consumer.

Access and accounts

You must be legally capable of entering into the relevant transaction. If you allow a minor to use the Services, you remain responsible for supervising their use where the law permits.

You must provide information that is accurate, current and complete and that you are authorised to provide. You are responsible for maintaining the confidentiality of your account credentials and for notifying us promptly if you reasonably suspect unauthorised use. Accounts are personal and must not be sold or transferred without our agreement.

Marketing emails and SMS messages are optional. We will send them only where we have an appropriate lawful basis, and you may unsubscribe as described in our Privacy and Cookies Policy.

Products and Services

We take reasonable care to describe and display products accurately. Colours and appearance may vary because of photography, manufacturing tolerances and device settings. Measurements and age guidance are approximate unless stated otherwise.

Products, prices and availability may change. We may limit quantities, correct an error or discontinue an item, but we will not make a material change to an accepted order without contacting you and respecting your applicable rights.

Unless stated otherwise, promotional prices and delivery offers displayed on the UK storefront apply to orders delivered to eligible UK addresses. International duties, taxes and charges may apply as described in our Shipping Policy.

Product safety recalls

From time to time, we may undertake a voluntary or mandatory product recall or other product-safety corrective action. The applicable recall notice, safety instructions and country-specific information form part of these Terms. If there is a conflict, the recall notice takes priority for that recall.

Eligibility depends on the affected product, identifying information such as its ISBN, the country in which it was purchased and any other criteria stated in the recall notice. We may ask for reasonable information or evidence to verify that a request relates to an affected product and to prevent duplicate, inaccurate or fraudulent claims. Unless the recall notice says otherwise, a separate request and the specified evidence must be submitted for each affected product.

You must provide information that is complete and accurate to the best of your knowledge and follow the published safety and disposal instructions. Do not return or post a recalled product unless we specifically ask you to do so. Keep your claim reference and tell us promptly if relevant information changes.

We may contact you for clarification or further reasonable evidence. We may delay or decline a request that is incomplete, duplicated, outside the recall scope or reasonably suspected to be fraudulent. We will not impose an evidence requirement that unlawfully prevents an eligible consumer from receiving a mandatory remedy.

For an eligible, verified claim, we will provide the remedy or choice of remedies described in the recall notice. The available remedy, method, value and timing may vary where required or permitted by the law of the country concerned. A payment or fulfilment provider may apply reasonable delivery or redemption terms, which will be made available before they apply.

We may update the administrative arrangements for a recall or close an online claim route when the recall and our legal obligations have ended. A change will not remove a mandatory consumer right or unfairly prejudice a valid claim already submitted.

Participation in a recall, receipt of a remedy or disposal of an affected product does not require you to waive any non-excludable consumer, product-liability or other legal right. A person submitting a recall request confirms that they are at least 18 years old or otherwise legally able and authorised to submit it for themselves or the product owner. Do not provide a child's personal information through a recall form.

Orders

Submitting an order is an offer to purchase. We will acknowledge receipt, but the order is accepted only when we send confirmation that it has been accepted or dispatched, depending on the wording of the confirmation. We may decline or cancel an order for a legitimate reason, including unavailability, an obvious pricing error, failed payment, suspected fraud or a delivery restriction. If we cancel after taking payment, we will refund the relevant amount.

You confirm that purchases are for lawful personal, family or household use unless we agree otherwise. Our Return and Refund Policy explains cancellation, return and remedy rights.

Prices and payment

The price payable is the price shown at checkout when the order is submitted, together with any applicable tax, delivery, handling or customs charge shown or properly disclosed. If an obvious error affects an order, we will contact you before proceeding.

You must provide accurate billing and payment information and be authorised to use the selected payment method. Payment services are provided by Shopify and other payment providers under their applicable terms. If you require a VAT receipt, contact enquiries@makebelieveideas.com.

Shipping and delivery

Available delivery methods, charges, estimates, destination limitations and responsibility for international import costs are described in our Shipping Policy and at checkout. Delivery estimates are not guaranteed unless expressly stated. Risk passes as required by applicable consumer law.

Promotions and special offers

Promotions may have additional terms displayed with the relevant offer. Those terms, together with these Terms, apply while the promotion is available.

Unless an offer expressly says otherwise:

  • it applies only to the products, dates, countries and customers identified;
  • it is subject to availability and any clearly stated quantity limit;
  • it cannot be combined with another voucher, discount, bundle, multi-buy, sale price or special offer;
  • it has no cash alternative and is not transferable;
  • a refund reflects the amount actually paid; and
  • where part of a bundle or multi-buy is returned, the refund may be recalculated to reflect the price of the items kept.

We may correct, extend, withdraw or cancel a promotion where reasonably necessary, but this will not affect an accepted qualifying order or a mandatory consumer right. Time-limited promotional terms should be read on the relevant offer page or advertisement.

Illustrator and portfolio submissions

If you submit an illustrator portfolio, work sample or creative proposal, you confirm that you are at least 18 years old, that you own the submitted material or have permission to provide it, and that our limited review of it will not infringe another person's rights.

You retain ownership of your submitted work. You give us a limited, non-exclusive, royalty-free permission to store, reproduce internally and share the material with members of our staff and service providers only as reasonably necessary to receive, administer and assess the submission and discuss a possible opportunity with you. Submitting work does not give us permission to publish it, use it in a product or use it for marketing without a separate agreement.

Do not submit trade secrets, confidential third-party information, sensitive personal information or material that you are not authorised to disclose. Submission does not create an employment, agency, commissioning or other contractual relationship, does not guarantee a response and does not oblige either party to proceed with an opportunity.

We handle submission information as described in our Privacy and Cookies Policy. A portfolio submission does not subscribe you to marketing.

Intellectual property

Except for material submitted by users or expressly identified otherwise, the Services and their text, illustrations, artwork, photographs, graphics, branding, video, audio, design and layout are owned by or licensed to Make Believe Ideas Ltd and are protected by applicable intellectual-property laws.

You may use the Services for lawful personal, non-commercial purposes. No licence is granted to copy, modify, distribute, sell, scrape, republish or commercially exploit our content except with prior written permission or where the law permits.

Optional tools and third-party links

The Services may make third-party tools, content or links available. We do not control independent third parties and are not responsible for their separate content or practices. Review their terms and privacy information before using their services. Nothing in this section excludes responsibility that the law places on us.

Relationship with Shopify

Shopify provides the ecommerce platform used to host and operate our store. Purchases from this store are made from Make Believe Ideas Ltd. Shopify and other providers may process information or provide payment and technical services as described in our Privacy and Cookies Policy and their own applicable notices.

Privacy

Our collection and use of personal information is described in our Privacy and Cookies Policy. Privacy rights and international-transfer safeguards are governed by applicable data-protection law, not by a blanket consent in these Terms.

Feedback

If you voluntarily provide general feedback or suggestions, you permit us to consider and use that feedback for our business without payment, provided that doing so does not override a separate confidentiality or intellectual-property agreement. This section does not apply to illustrator portfolios and work samples, which are covered separately above.

Errors and availability

We may correct typographical errors, inaccuracies and omissions and update information. If a material error affects an order already submitted, we will contact you and respect your cancellation and refund rights.

Prohibited use

You must not use the Services unlawfully or abusively, interfere with their security, introduce malicious code, infringe another person's rights, submit fraudulent information, send unsolicited messages, scrape the Services contrary to law or permission, or attempt to bypass access controls.

We may restrict access where reasonably necessary to protect the Services, our customers or third parties, or where we reasonably believe these Terms or the law have been breached. This will not affect rights relating to an accepted order unless the law permits.

Consumer guarantees and liability

We do not exclude or limit liability where it would be unlawful to do so. This includes liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, and any mandatory consumer, product-safety or product-liability right.

Products must be as described, of satisfactory quality and fit for any purpose made known where applicable law requires. Statements elsewhere in these Terms about availability, estimates or third parties do not remove those obligations.

Subject to the preceding paragraphs, we are not responsible for loss that was not reasonably foreseeable when the relevant contract was formed, or for business loss arising from a consumer purchase. Different limitations may apply to a business customer under a separately agreed contract.

Severability and waiver

If a court or competent authority finds part of these Terms unlawful or unenforceable, the remaining provisions continue to apply. A delay in enforcing a right is not a waiver of that right.

Transfer of these Terms

We may transfer our rights and obligations where this does not reduce your guarantees or other rights. You may transfer your rights where the law permits or with our written agreement.

Governing law and disputes

These Terms are governed by the laws of England and Wales. If you are a consumer living elsewhere, you retain the benefit of any mandatory protection provided by the law of your country and may have the right to bring proceedings in your local courts. Nothing in these Terms requires a consumer to give up a forum or remedy that cannot lawfully be excluded.

MP3 and QR-code content

Some books contain QR codes linking to MP3 or other digital content hosted through our website or a provider. We take reasonable care over files we supply, but availability and device compatibility may change. Use appropriate device security. Nothing in this paragraph limits rights relating to defective or unsafe digital content.

Changes to these Terms

We may update these Terms from time to time. The latest version and its effective date will appear here. A change will not retrospectively reduce rights under an order already accepted. We will provide additional notice where the law requires it.
